This document is an electronic record in terms of the Information Technology Act, 2000 and is published in accordance with the provisions of Rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2011, as amended from time to time.

This document sets out the Terms of Use (“Terms”) governing access to and use of the Jewelmart website and mobile application (collectively referred to as the “Platform”).

The Platform is owned and operated by Jewelmart Private Limited, having its registered and operational offices in India (details available on the Platform).

By accessing, browsing, or using the Platform in any manner, you agree to be bound by these Terms of Use, along with all applicable policies of Jewelmart, including the Privacy Policy, Return Policy, Cancellation Policy, and Exchange Policy, as amended from time to time.

Definitions

“You” / “User” means any natural or legal person who accesses or uses the Platform, whether registered or not.
“Jewelmart”, “We”, “Us”, “Our” refer to Jewelmart Private Limited and its affiliates.
“Products” mean jewellery and related items listed on the Platform.

Jewelmart reserves the right to modify these Terms at any time without prior notice. Continued use of the Platform constitutes acceptance of the revised Terms.

1. User Account, Registration, and Security

1.1 To place orders for jewellery products on the Platform, account registration is mandatory. Guest checkout is not permitted.

1.2 When creating an account, you agree to:

Provide true, accurate, current, and complete information
Maintain and promptly update your account details
Keep your login credentials confidential

1.3 You are solely responsible for all activities conducted through your account.

1.4 You agree to immediately notify Jewelmart of any unauthorized use, security breach, or suspected compromise of your account.

1.5 Jewelmart reserves the right to suspend or terminate accounts that:

Provide false, inaccurate, or misleading information
Violate these Terms or applicable laws

2. Services Offered

2.1 Jewelmart provides an online marketplace that enables users to browse and purchase jewellery and related products using available payment methods.

2.2 All purchases are subject to additional policies including:

Cancellation Policy
Return Policy
Exchange Policy

These policies form an integral part of these Terms.

2.3 At the time of initiating a return request, users must confirm that:

The product is unused
Original tags, certificates (if applicable), and packaging are intact

2.4 If a returned product is found to be used, damaged, altered, or missing original tags or certificates:

The return request may be rejected
The product may be re-shipped to the user
No refund shall be issued
Jewelmart shall bear no liability

2.5 Product descriptions, images, weights, prices, and other details are provided for informational purposes only and may vary slightly due to photography, screen resolution, or manufacturing processes.

3. Pricing Disclaimer (Gold & Silver Jewelry)

3.1 Prices of gold and silver jewellery are subject to daily market fluctuations.

3.2 Jewelmart reserves the right to update product prices at any time without prior notice.

3.3 The final price applicable to an order shall be the price displayed at the time of order confirmation.

3.4 In case of pricing errors caused by technical or typographical issues, Jewelmart reserves the right to cancel the order and refund the amount paid.

4. Platform as a Facilitator

4.1 The Platform acts solely as a facilitator for transactions between buyers and sellers.

4.2 Jewelmart:

Is not a party to the contract between buyers and sellers
Does not own, sell, or control the products listed unless expressly stated

4.3 All commercial terms including price, delivery timelines, warranties, and after-sales services are determined by sellers.

4.4 Jewelmart shall not be responsible for:

Non-performance or breach of contract between users
Delays due to logistics, stock unavailability, or force majeure events
Product quality, authenticity, or suitability

4.5 You agree to indemnify and hold Jewelmart harmless from any claims, losses, damages, or disputes arising from transactions or interactions on the Platform.

5. User Conduct and Platform Rules

You agree not to use the Platform to upload, post, or transmit any content that:

Violates any applicable law or regulation
Is false, misleading, defamatory, obscene, abusive, or offensive
Infringes intellectual property or privacy rights
Promotes illegal, fraudulent, or harmful activities
Contains viruses, malware, or harmful code
Attempts unauthorized access to systems or accounts

Users may be classified as fraudulent or abusive if they engage in activities including but not limited to:

Providing incorrect contact or address details
Misuse of offers, vouchers, or promotions
Refusal to accept delivery or make payment
Returning used, damaged, or incorrect products
Placing bulk or resale-oriented orders
Any activity intended to cause financial loss to Jewelmart

Jewelmart reserves the right to cancel orders, suspend accounts, or permanently restrict access in such cases.

6. Bulk Orders & Fair Usage

6.1 Jewelmart is a consumer-focused platform and does not support business-to-business transactions.

6.2 Orders suspected to be for:

Commercial resale
Bulk purchasing
Policy abuse

may be cancelled without prior notice.

6.3 Users intending to claim input tax credit (ITC) are advised not to transact on the Platform.

7. Intellectual Property

All content on the Platform including logos, images, text, designs, graphics, and software is the property of Jewelmart or its licensors and is protected under applicable intellectual property laws.

Unauthorized use, reproduction, or distribution is strictly prohibited.

8. Limitation of Liability

To the maximum extent permitted by law, Jewelmart shall not be liable for:

Any indirect, incidental, special, or consequential damages
Loss of profits, data, goodwill, or business opportunities

arising out of or related to the use of the Platform or products purchased through it.

9. Termination

Jewelmart reserves the right to suspend or terminate your access to the Platform at any time, without notice, for violation of these Terms or applicable laws.

10. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of India. Courts located in India shall have exclusive jurisdiction.
